Effective February 15, 2021, gestational surrogacy is permitted by statute in New York. The new statute, the Child Parent Security Act (CPSA), permits compensated gestational surrogacy for the first time and repeals New York’s existing statute that declares compensated surrogacy contracts void and unenforceable. 

 

Under the new statute, courts will grant pre-birth parentage orders to heterosexual couples, same-sex couples, and single parents, but the order will not be effective until birth. The statute currently applies only to Intended Parents who currently reside in New York State and at least one parent has been a resident for at least six months. (Check back here for any changes to this requirement.)

Pursuing gestational surrogacy can be a stressful, time-consuming, and costly process. We will be with you every step along the way. 

1.

Complete the initial short application form online. We will reach out to you to schedule your initial consultation.

2.

If you don't have a designated attorney, we will coordinate such service so all the legal aspects of gestational surrogacy can be discussed and proper documents are signed. 

3.

After you have picked your IVF clinic and completed all required screening, we will start the matching process. 

4.

You will meet your potential pre-screened surrogate through video. 

5.

If you decide to proceed with the surrogate, we will coordinate between the surrogate and your IVF clinic to ensure all requirements are met. 

6.

Applicable services will be coordinated for both you and the surrogate until the contract is signed. 

7.

We will coordinate all applicable services to best support the surrogate mother, her relationship with you and to ensure that the legal process is followed.
